WASHINGTON.- El Tribunal Supremo de Estados Unidos, de mayoría conservadora, dio este viernes la razón a una diseñadora gráfica cristiana que se niega a crear páginas web para bodas de parejas homosexuales.
Lorie Smith, una cristiana evangélica, denunció al estado de Colorado en 2016 con la intención de lograr una excepción a la ley de derechos civiles estatal para ofrecer únicamente servicios a parejas heterosexuales.
El alto tribunal le dio la razón con el apoyo de los seis jueces conservadores del Supremo y el voto en contra de las tres magistradas progresistas.
El juez conservador Neil Gorsuch, autor del fallo, escribió que la negativa de Smith está amparada por la Primera Enmienda de la Constitución de Estados Unidos, que blinda la libertad de expresión y de religión.
«Colorado está obligando a una persona a alinearse con sus puntos de vista desafiando su conciencia sobre un asunto de gran importancia», relata la decisión de la mayor instancia judicial del país.
En una opinión de disentimiento, la jueza progresista Sonia Sotomayor advirtió que por primera vez en la historia el Tribunal Supremo está entregando a una empresa el derecho constitucional a «negarse a dar servicios a miembros de una minoría social».
La empresa de Smith, 303 Creative, todavía no está activa con lo que el caso no cuenta con una pareja afectada.
Pero durante una audiencia ante el Supremo el pasado diciembre, la defensa de Smith argumentó que la mujer cree que el matrimonio entre personas del mismo sexo no debe existir.
El Supremo ya respaldó por poco en 2018 a un pastelero de Colorado que rechazó hacer una tarta nupcial a una pareja homosexual.
Esta es la última en una serie de sentencias que expanden los derechos religiosos en el país, después de que el año pasado el tribunal, de mayoría conservadora, diera la razón a un entrenador cristiano que fue suspendido de su trabajo en un instituto por negarse a dejar de rezar con sus jugadores tras los partidos.
Este mismo jueves, el tribunal dio la razón a un cartero cristiano que demandó al Servicio Postal por rechazar su petición para no trabajar en domingo.
