EL PORTAVOZ, SANTO DOMINGO.-El exministro Administrativo de la Presidencia, José Ramón Peralta, no debe permanecer en prisión preventiva porque la misma es arbitraria en virtud de que, entre otras razones legales, no existen evidencias que lo vinculen con los hechos que se le imputan, afirmaron dos de sus abogados.
Los juristas señalaron que ninguna persona debe estar en prisión sobre la base de unas declaraciones premiadas carentes de sustento, como, aseguran, es el caso de Peralta.
Precisaron que, entre otras razones, su prisión preventiva no es válida debido a que se postergó en dos meses la revisión obligatoria, además de que las decisiones de los jueces no tienen las motivaciones suficientes como ordena la ley.
Entrevistados en el programa de radio “Cuentas Claras”, que se difunde por la emisora La Nota, 95.7. F.M., Emery Rodríguez y Pedro Balbuena, consideraron inverosímil que en una Estado Social y Democrático de Derecho su defendido lleva más de 140 días en esa situación de privación de libertad.
“En un Estado de Derecho, a una persona no se le puede recluir en prisión porque al juez se le ocurra pensar de esa manera, es necesario que existan decisiones debidamente motivadas y justificadas”, expresaron
Rodríguez y Balbuena afirmaron que Peralta, implicado en el caso denominado Calamar, “es inocente de los hechos que se le imputan, tal y como él mismo lo ha expresado”.
En el contexto anterior, indicaron que la prisión parte de una situación que no pueden ser consideradas pruebas en virtud de que se trata de delaciones premiadas infundadas.
Dijeron que de todas maneras confían en la justicia y el derecho, por lo que seguirán ejerciendo los recursos que la ley pone a su alcance hasta lograr el cese de la prisión preventiva a la mayor brevedad posible.
