SANTO DOMINGO.– Al acoger la petición del Ministerio Público, el Sexto Juzgado de la Instrucción del Distrito Nacional ratificó este miércoles la prisión preventiva al general Julio Camilo de los Santos Viola y a José Manuel Rosario Pirón, procesados por corrupción administrativa en el caso Coral 5G.

La petición del Ministerio Público, encabezado por el procurador adjunto Wilson Camacho, responsable de la Procuraduría Especializada de Persecución de la Corrupción Administrativa (Pepca), fue acogida por la jueza Yanibet Rivas, al demostrar que no han variado los presupuestos que dieron origen a la imposición de la misma.

Miguel Collado, fiscal litigante adscrito a la Pepca, ponderó que el tribunal entendió que no han variado las condiciones que dieron lugar a la prisión preventiva y que, por consiguiente, decidió mantener la medida de coerción.

“El tribunal ha conocido, primero, una revisión, estaba fijada la revisión obligatoria en contra de los acusados Adán Cáceres, Rafael Núñez, Tanner Flete y Rossy Guzmán, pero fue dejada sin efecto, en razón de que el día 6 de diciembre le fue variada la medida de coerción, en consecuencia, la audiencia no tiene razón de ser”, detalló, al responder preguntas de la prensa sobre el proceso en el Palacio de Justicia de Ciudad Nueva.

“Asimismo, con relación a los acusados Boanerges Reyes Batista y Franklin Mata Flores hubo una audiencia en la Corte de Apelación, específicamente en la Segunda Sala, en fecha 5 de diciembre, y el tribunal tiene como criterio, así lo establece también el Código Procesal Penal en su artículo 239 que, cuando se conoce una apelación, el plazo de la revisión obligatoria de la medida de coerción, entonces, vuelve a transcurrir, vuelve a ser contado desde cero”, añadió.

Con las operaciones Coral y Coral 5G que involucran a imputados por corrupción administrativa, el Ministerio Público presentó cargos por ese delito contra 48 personas, 30 personas físicas y 18 personas jurídicas, imputadas de defraudar al Estado dominicano con más de 4,000 millones de pesos.

El entramado de corrupción operó en el Cuerpo de Seguridad Presidencial (Cusep), el Cuerpo Especializado de Seguridad Turística (Cestur) y el Consejo Nacional para la Niñez y la Adolescencia (Conani).

En la Operación Coral 5G, derivada de la Operación Coral, fueron arrestados los generales Juan Carlos Torres Robiou (FARD), Boanerges Reyes Batista (ARD) y Julio Camilo de los Santos Viola (FARD), así como el capitán de navío ARD, Franklin Mata Flores, y José Manuel Rosario Pirón.

En el caso también están implicados Carlos Lantigua, Alfredo Pichardo, Erasmo Roger Pérez, Jehohanan Lucía Rodríguez, Yehudy Blandesmil Guzmán y Esmeralda Ortega Polanco.

Entre los imputados de la Operación Coral figuran el mayor general Adán Cáceres Silvestre, Rossy Guzmán Sánchez (La Pastora), el cabo policial Tanner Antonio Flete Guzmán (hijo de la religiosa), el coronel policial Rafael Núñez de Aza y el sargento de la Armada Alejandro José Montero Cruz.
