SANTO DOMINGO.-Los abogados de José Ramón Peralta Fernández denunciaron este viernes que el Ministerio Público «continúa obstaculizando la justicia con la única finalidad de mantener ilegalmente a su defendido en prisión

Pedro Balbuena, quien fungió de vocero de la defensa del exministro administrativo de la Presidencia durante los gobiernos de Danilo Medina, dijo que el Ministerio Público insiste en evitar que un juez escuche a Peralta Fernández con el propósito de que no se conozca la verdad en torno a una infundada acusación.

“Aquí se pretende que no se conozca la verdad; por eso el Ministerio Público obstaculiza que un juez revise la medida de coerción de prisión de José Ramón Peralta Fernández, quien hoy lleva 226 días en prisión arbitraria, ilegal e injusta”, expresó.

Balbuena se refirió al tema luego de que la jueza encargada del caso en el Segundo Juzgado de Instrucción del Distrito Nacional, Ana Lee Florimón, aplazara el conocimiento para el próximo martes, a fin de citar a la familia Mota, uno de los querellantes en el proceso. Completan el Equipo Legal, Santiago Rodríguez, Emery Rodríguez y Chanel Liranzo.

Dijo que, en la audiencia, el Ministerio Público al fallar en su intento de convencer a la magistrada de que aplazara el conocimiento del caso, recurrió a una estrategia con ese mismo sentido, recurriendo a uno de los actores civiles.

Sin razón para la prisión

Balbuena consideró que lo que procede en derecho es que Peralta Fernández sea excluido del expediente por no haber cometido crimen o delito alguno.

Planteó que su defendido ha llevado una vida pulcra en su accionar, tanto en lo público como en lo privado, “lo cual ha sido corroborado públicamente por personalidades de incidencia en la vida nacional”.

Señaló que el exministro Administrativo de la Presidencia ha sido desde el primer día un preso sin causa y al margen de la ley, en virtud de que conforme a la legislación dominicana para una persona ser reducida a prisión es imprescindible la existencia de una apariencia de delito y de la participación de la persona en la comisión del mismo.

En este caso no concurren ni una cosa, ni la otra, agregó, lo único aportado por el Ministerio Público para pretender generar la apariencia de un ilícito, y de su vinculación con el mismo, fue un interrogatorio realizado el 9 de diciembre de 2022 al delator premiado Bolívar Ventura, quien afirma haberse reunido con el señor José Ramón Peralta Fernández y que supuestamente recibió instrucciones suyas y que entregó, a través de un tercero, la suma de 527 millones, 634 mil 838 pesos.

Indicó que la mera delación de un imputado, sin haber sido sometida a diligencias de corroboración, no es razón para reducir a prisión preventiva a una persona, como ha sucedido con José Ramón Peralta Fernández, “por lo que afirmamos que es un preso sin causa y al margen de la ley”.
