El Ministerio de Administración Pública (MAP) emitió una circular en donde se establecen los lineamientos a seguir para la aplicación de suspensión en funciones o licencias especiales para candidatos a ocupar cargos de elección popular, que sean funcionarios o servidores públicos.
De acuerdo con lo establecido en las diferentes leyes que regulan la participación de los funcionarios o servidores públicos en las elecciones generales, el MAP indicó que se exceptúan de la suspensión en servicio y de la necesidad de tomar licencias especiales, los postulados a tales cargos municipales o congresuales, que, al momento de la aceptación de sus candidaturas se desempeñen como servidores públicos que ocupan cargos que no tengan jerarquía y no manejen fondos públicos; al igual que aquellos servidores públicos que ocupen cargos electivos, los que no podrán prevalerse de su condición en actos públicos o ante los medios de comunicación, según lo dispuesto por el artículo 145, párrafo III y IV, de la citada Ley núm. 20-23.
La circular firmada por el ministro de Administración Pública, Darío Castillo Lugo, señala que los candidatos a cargos municipales o congresuales, que ocupen cargos de alto nivel según lo dispuesto en el artículo 20 de la Ley núm. 41-08. de Función Pública, los cuales son de libre nombramiento y cuya designación corresponde al presidente de la República, en su condición de jefe de gobierno, según lo dispuesto en el artículo 128 de la Constitución, serán sustituidos de manera interina mediante decreto del presidente de la República, por un periodo Igual a la suspensión en servido o licencia especial.
Todos los funcionarios públicos que tienen jerarquía y manejan fondos públicos, del gobierno central, de los organismos desconcentrados y autónomos del Estado, así como de los ayuntamientos y Juntas de Distritos Municipales, cuya postulación a cargos electivos, hayan sido aceptadas por la Junta Central Electoral (JCE) y las Juntas Electorales correspondientes, quedarán suspendidos en sus funciones sin disfrute de sueldo, desde el día de la aceptación de dicha candidatura, hasta el día siguiente de las elecciones a la que aspiren.
Los candidatos a cargos municipales de alcaldes, vicealcaldesa, regidores, directores de Juntas de Distritos Municipales, suplentes y vocales que tengan que tomar la licencia debido a sus funciones como servidor público, serán excluidos de las nóminas de los meses de enero y febrero de 2024; en el caso de los candidatos a los niveles senatorial y de diputaciones, cuyas propuestas de candidaturas deberán ser presentadas a la JCE a más tardar 15 días después de las elecciones municipales (artículo 147, Ley 20-23), que estén en la misma condición deberán ser excluidos de las nóminas de los meses de marzo, abril y mayo de 2024.
El documento señala que esos funcionarios y servidores públicos que participen en ambos niveles electorales serán reintegrados a sus funciones al día siguiente de las elecciones que le corresponda (febrero o mayo).
